LAFAYETTE, Ind. (WLFI) — The Tippecanoe County Area Plan Commission is giving preliminary approval for a lot addition that has wetlands in West Lafayette.
Tippecanoe Development LLC will add 42 lots north of Westmoreland Drive. The US Army Corps of Engineers says the wetland areas involved are not regulated by the Clean Water Act.
The Indiana Department of Environmental Management will still need to determine if state law applies to the development.
Attorney for Tippecanoe Development Kevin Riley says the developers will work within the limits of the law.
"The petitioner got confirmation from the Army Corps of Engineers that their regulations don't have any bearing or impact on the wetlands that are out there, and the petitioner will work with IDEM to make sure that they deal with the wetlands appropriately," said Riley.
The unanimous vote is only for the addition of previously zoned lots. Construction plans have yet to be introduced.
