CLINTON COUNTY, Ind. (WLFI) — A limited liability company in the middle of a legal battle in Clinton County is asking for a protective order in a civil case filed by the county commissioners.
As News 18 previously reported, Sheriff Rich Kelly and his wife, Ashley Kelly, are accused of forming Leonne LLC days before Kelly took office.
Commissioners say the LLC was created deceptively to to collect profits from jail commissary sales.
As part of the civil case, commissioners requested two years worth of the LLC's bank records.
But Kelly's defense attorneys say he records were already provided to several state agencies, such as Indiana State Police and the State Board of Accounts, and they argue the request is "to annoy, harass and oppress the Clinton County Sheriff for political gains."
Attorneys are also asking Leonne LLC to be removed from the suit.
"We think they're just asking for these documents for irritation purposes," says Frankfort-based attorney Richard Martin. "I think they certainly can get the documents from other sources just as easily as asking the corporation."
A hearing on the protective order is set for October 26th.
News 18 reached out to Clinton County commissioners but hasn't heard back.
