64-year-old Delphi bicyclist dead after being hit by pickup truck driver

Tyler Levin says he was was checking his phone and didn't see Charles Maxwell riding his bike until it was too late.

CARROLL COUNTY, Ind. (WLFI) - A Saturday morning Carroll County crash, involving a pickup truck and a bicyclist, resulted in the death of a 64-year-old rural Delphi man.

At 8:56 a.m., Carroll County E911 dispatch received a report of the accident on County Road 400 South, just east of the town of Ockley.

Upon arrival, Carroll County Sheriff Tobe Leazenby said police found Charles W. Maxwell unresponsive at the scene. He said CPR was initiated on scene by Flora Police Officer Jarred Beaver. However, Maxwell was later pronounced dead, from what appeared to initially be internal injuries, at the scene by Carroll County Coroner Kristen Enoch.

Sheriff Leazenby said Deputy Steven Tkachuk’s investigation indicated that Maxwell was bicycling eastbound on County Road 400 South in the eastbound lane.

Thirty-four year old Tyler Levin of Burlington was also eastbound on County Road 400 South. Levin admitted to police that he was checking his cell phone and his attention was not on the roadway. Levin advised when he looked up, the bicyclist was in front of him, and he could not avoid striking him.

Sheriff Leazenby confirmed that the phone was in his hand while driving. As we've previously reported, Indiana's hands-free driving law went into effect three days ago, making it illegal for all drivers in Indiana to hold their cell phones in their hands while operating a vehicle.

Levin was driving a 2007 Chevrolet Colorado pickup truck. According to the report, Levin struck the bicyclist with the right front fender and right side of the windshield of the truck.

Maxwell was ejected from the bicycle and landed in a soybean field on the south side of County Road 400 South. He was wearing a bicycle helmet.

Levin was taken into custody and booked into the Carroll County Jail on preliminary charges of Reckless Homicide and Criminal Recklessness involving a Vehicle, both level 5 felonies. Levin later posted a $10,000 cash bond and was released pending an initial hearing on the charges in Carroll Circuit Court on July 10th, 2020 at 10:00 a.m.

Police do not believe alcohol or drugs were a factor in the accident.
