LOGANSPORT, Ind. (WLFI) - A lawsuit filed against the city of Logansport is moving forward.
Logansport resident Julie Kitchell filed the lawsuit in March.
The lawsuit claimed the city didn't follow a law saying they needed to give themselves authority to receive bids for the new power plant project.
Mayor Ted Franklin filed a motion to dismiss the case, based on another law that allows the city to ratify any motion taken, after the fact.
Kitchell's attorney, Jim Brugh, says he filed a response to that motion.
Brugh says the case will now go to the judge who will determine which side is correct.
Brugh says he does not know when a decision will be made.
