Scott Malott brought back to Montgomery County

MONTGOMERY COUNTY, Ind. (WLFI) - Montgomery County police suspect a domestic dispute led to a fatal shooting Monday morning near New Richmond.

Police say it all started when a man waived down a passing motorist on Montgomery County Road 1200 North.
That man, Roger Lyman, 32,  of Colfax told the driver someone had fired shots at him and killed 30-year old Heather Rush.

"We have a person by the name of Scott Malott that potentially left the scene that may have information in regards to this homicide," Chief Deputy Gary Truax said.

Truax said the problems between Malott, Lyman, and Rush started around midnight.  He said Lyman told police for some reason he and Rush felt as if they were being confined to the house by Malott.  Truax said Lyman told police he thought Malott had calmed down.  But he then told police when he went to the bathroom, Malott shot Rush.

Truax said Rush's children were in the house when their mother was shot.

"There were four children in the house.  They were asleep in the back bedroom. Child protective services came and pick up those children and took them to their office. They have since then been released to their father and the grandparents,"  Truax said.

Police said Malott ended up at a friend's house five miles west of Anderson, Indiana.
Madison County Sheriff Ron Richardson said Malott called his department to see if there was a warrant for his arrest.

The sheriff said Malott told the officer he had been involved in an incident in Montgomery County and wanted to surrender.  He was taken into custody without incident.

Sheriff Richardson said a handgun was found on the floorboard of Malott's pickup truck.

Malott is now being held in the Montgomery County jail.

Truax said Rush had just moved in with Malott about a week ago.
