TIPPECANOE COUNTY, Ind. (WLFI) - Lawyers have three weeks to further their cases of whether or not a Tippecanoe County kennel expanded illegally.
A public hearing was held Wednesday night for Randy Sanders, owner of Sanders Border Collies. He is appealing the decision that he expanded a non-conforming kennel operation illegally.
Joe Bumbleburg, the lawyer for the Tippecanoe County Board of Zoning Appeals, said that means, when he opened his business, it was done legally, but changes to an ordinance have made the expansion of his business illegal.
Sanders' attorney and an attorney representing the Tippecanoe County building commissioner argued their positions. The board heard testimony from the building commissioner, Sanders, and one of his neighbors. The board then gave the attorneys three weeks to provide their findings of fact and conclusion of law.
"We have now ordered the two lawyers to provide one of these documents, each stating what they think they accomplished for their clients, what their positions are," Bumbleburg said.
The board will then meet in a an executive session to discuss the documents. Next, members will vote in a meeting to determine if Sanders expanded illegally. If they do, Sanders could possibly be forced to close his business.
