Logansport sued by resident

LOGANSPORT, Ind. (WLFI) - A Logansport resident is suing the city over the process taken to receive bids for the new power plant.

Julie Kitchell filed the lawsuit against the city and the city council Monday.

According to Kitchell's attorney Jim Brugh, the city violated a law stating the city must give itself authority to receive bids before asking for them.

"Is Julie Kitchell right when she takes the position that this ordinance is invalid?" Brugh said. "That will be determined by a court."

Attorney John Molitor, who represents the city, another law allows the city to ratify any action they have already taken, which they did at their March meeting.

"Even if his original concept had any weight," Molitor said. "We dealt with it by ratifying the actions that we've previously taken."

Mayor Ted Franklin says because corporations have invested money into the city already, he will fight the suit to have progress continue.

"We reached out and asked for some helping hands to form some partnerships and we had a large amount of interest in it," Franklin said. "As the mayor, I'm going to make sure we protect those interests."

Franklin filed a motion to dismiss the case Monday, as well.

The judge denied his motion to expedite the dismissal, giving Brugh until April 9 to respond.
