Evansville police say a man flagged down police and surrendered…

INDIANAPOLIS (AP) - Indiana Pacers owner Herb Simon wants the Indiana Supreme Court to hear a defamation lawsuit he and his wife have filed against a California attorney.
The Indianapolis Star reports that Indiana's highest court will hear oral arguments Oct. 24 on whether a state appeals court ruled correctly in favor of attorney Joseph A. Davis in dismissing the lawsuit.
Simon and his wife, Bui, contend Davis defamed them in a 2010 interview with WTHR-TV over the firing of a nanny at their California home. Davis represents the nanny.
The nanny's lawsuit seeking back wages was dismissed by a California judge.
