LOGANSPORT, Ind. (WLFI) - 32-year-old Jason Burkett of Logansport is back in the Cass County Jail. He left just four months ago when he was released after his 2004 conviction of rape and criminal confinement was overturned.
He served nearly nine years of a 40-year sentence.
Now, he is facing two charges of voyeurism with a camera.
Logansport Police Detective, Brad Smith, led the investigation against Burkett.
"It was reported Mr. Burkett had allegedly recorded an adult female and a juvenile using the restroom without their knowledge," Smith said.
Smith said the video recordings happened inside a garage and a home on West Broadway Street in Logansport. Smith said these new charges are not related to his previous charges and conviction.
"I was looking into the evidence in the case of voyeurism, and I was informed of his previous charges," Smith said. "I had no knowledge of it prior to this investigation."
Although the charges are not related, Burkett did violate the terms of his release by allegedly committing another crime.
If convicted of voyeurism, he could face one and a half to three years in prison.
Cass County Prosecutor, Kevin Enyeart, said he is appealing Burkett's overturned conviction. He said if the appeal is lost, he will try Burkett again with rape and criminal confinement.
Burkett's bond for his voyeurism charges is set at $25,000 cash. However, since he did violate his release agreement, a judge has ordered Burkett not be released for the time being.
Burkett will appear in court Friday morning.
